These Terms of Service (“Terms”) govern your access to and use of the websites, publications, events, memberships, products, services, directories, content, and digital properties operated by New Orleans Weddings Magazine, Inc. d/b/a NOW Weddings Magazine (“NOW Weddings Magazine,” “NOW,” “we,” “our,” or “us”), including nowweddingsmagazine.com and related websites, publications, events, and services.

By accessing or using our website, registering for an event, creating an account, purchasing a membership, advertising, sponsorship, ticket, product, or service, submitting a vendor listing or other content, uploading photographs or materials, or otherwise engaging with us, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not use our websites, services, events, memberships, or products.

1. Eligibility

You must be at least 13 years of age to create an account or independently use account-based features of our website.

If you are under the age of majority in your jurisdiction, you may use services requiring a legally binding agreement only with the involvement or authorization of a parent or legal guardian where required by law.

By entering into a paid membership, advertising agreement, submission agreement, or other contract with NOW Weddings Magazine, you represent that you have the legal authority to do so.

2. Accounts

Certain features of our website, including Wedding Krewe memberships and vendor directory services, may require account registration.

You agree to provide accurate, current, and complete information when creating or maintaining an account.

You are responsible for:

• Maintaining the confidentiality of your username, password, and account information
• Restricting unauthorized access to your account
• All activity conducted through your account
• Promptly notifying us of suspected unauthorized access or security issues

We reserve the right to suspend, restrict, or terminate accounts that violate these Terms, contain inaccurate or fraudulent information, present security concerns, or are otherwise misused.

3. Wedding Krewe Memberships

NOW Weddings Magazine may offer memberships, including Wedding Krewe memberships.

Membership benefits may include vendor directory listings, promotional opportunities, networking opportunities, event benefits, educational opportunities, discounts, or other services described at the time of enrollment.

Membership benefits, features, pricing, and included services may be changed, modified, suspended, or discontinued from time to time.

Memberships are non-transferable unless otherwise approved by NOW Weddings Magazine in writing.

Members are responsible for maintaining accurate business, account, contact, billing, and listing information.

Renewal

Wedding Krewe memberships do not automatically renew unless automatic renewal is expressly disclosed and agreed to at the time of purchase.

If NOW Weddings Magazine offers an automatically renewing membership in the future, the applicable billing frequency, price, cancellation procedure, and renewal terms will be disclosed before enrollment.

4. Payments

By purchasing any membership, event registration, advertising package, sponsorship, digital product, service, or other offering, you agree to pay all applicable fees disclosed at the time of purchase or in the applicable agreement.

Payments may be processed by third-party payment providers, including Stripe.

You authorize the applicable payment processor to process charges you have approved in connection with your purchase.

NOW Weddings Magazine does not intend to store complete payment card numbers on its own website servers.

Failure to make required payments may result in suspension or termination of memberships, listings, advertising, services, event participation, or account access.

5. Refunds

Except where otherwise stated in writing or required by law, purchases of memberships, advertising, sponsorships, event registrations, tickets, products, or services are final and non-refundable.

Specific events, advertising agreements, membership offerings, products, or services may contain separate cancellation or refund terms. Those specific written terms will control where applicable.

6. Vendor Directory Listings

Eligible vendors and Wedding Krewe members may submit business information for inclusion in the NOW Weddings Magazine vendor directory.

Submission of a vendor listing does not guarantee publication.

NOW Weddings Magazine reserves the right to review, approve, reject, edit for technical or formatting purposes, categorize, temporarily hide, or remove a listing when reasonably necessary to:

• Maintain directory quality
• Correct technical or formatting issues
• Address inaccurate information
• Enforce these Terms
• Respond to complaints
• Protect users or NOW Weddings Magazine
• Comply with applicable law

Vendors are responsible for ensuring that their listings remain accurate, complete, and current.

NOW Weddings Magazine is not responsible for errors, omissions, outdated information, incorrect contact information, pricing, availability, or other information supplied by vendors.

7. Vendor Responsibility

Each vendor is responsible for the information and materials submitted through their account or provided to NOW Weddings Magazine.

This includes:

• Business names
• Business descriptions
• Contact information
• Service descriptions
• Pricing information
• Website links
• Social media links
• Logos
• Photographs
• Videos
• Testimonials
• Promotional claims
• Photo credits
• Copyright information
• Other uploaded materials

Vendors must not submit false, misleading, unlawful, defamatory, infringing, or otherwise unauthorized information or content.

8. Photographs, Copyright, and Uploaded Content

You may only upload, submit, provide, or authorize publication of photographs, images, videos, text, graphics, logos, or other materials that you have the legal right and authority to provide to NOW Weddings Magazine.

By submitting content, you represent and warrant that:

• You own the content or have obtained all necessary rights, licenses, releases, permissions, and authorizations required for the intended use
• NOW Weddings Magazine’s permitted use of the content will not infringe any third party’s copyright, trademark, privacy, publicity, contractual, or other rights
• You have obtained any required permission from photographers, creators, clients, individuals depicted in the content, or other rights holders
• Any photo credit or attribution information you provide is accurate to the best of your knowledge
• The content does not violate applicable law

A photographer credit does not constitute permission to use a photograph.

Vendors and other submitters remain responsible for obtaining permission from photographers and copyright owners before submitting their work.

You should not upload photographs or other materials obtained from social media, search engines, third-party websites, photographer portfolios, or other sources unless you have permission or another lawful right to use and submit them.

9. License to Submitted Content

By submitting content to NOW Weddings Magazine, you grant NOW Weddings Magazine a non-exclusive, worldwide, royalty-free license to host, reproduce, publish, display, format, resize, crop, distribute, archive, and otherwise use the submitted content for the purpose for which it was provided.

For content submitted for a vendor listing, editorial feature, promotional opportunity, publication, event, advertisement, or other marketing purpose, this license may include use in:

• NOW Weddings Magazine websites
• Print and digital publications
• Email communications
• Social media channels
• Promotional materials
• Event marketing
• Advertising related to NOW Weddings Magazine’s publications, directory, events, or services

Ownership of the underlying content remains with the applicable copyright owner unless otherwise agreed in writing.

Separate contracts, releases, advertising agreements, or submission terms may provide additional rights or restrictions.

10. Photo Credits

Where NOW Weddings Magazine provides a field or method to submit photographer or creator credits, users are responsible for providing complete and accurate credit information.

NOW Weddings Magazine may display submitted credits where reasonably practicable.

However, attribution may not appear in every thumbnail, crop, preview, social media format, advertisement, graphic, or other technical use.

The inclusion of a photo credit does not replace the requirement that the submitter have permission to use and provide the photograph.

11. Copyright Complaints

NOW Weddings Magazine respects intellectual property rights.

If you believe content appearing on our website infringes your copyright, please contact:

Please provide enough information for us to identify and review the material, including:

• Your name and contact information
• Identification of the copyrighted work
• The URL or location of the material on our website
• An explanation of why you believe the material is unauthorized

NOW Weddings Magazine may remove or disable access to disputed material while reviewing a complaint.

We reserve the right to remove content or restrict accounts associated with repeated or serious infringement.

12. Editorial Submissions and User Content

Submission of photographs, videos, real weddings, engagements, styled shoots, testimonials, vendor profiles, comments, reviews, articles, advertisements, or other materials does not guarantee publication, placement, social media coverage, editorial inclusion, or acceptance.

NOW Weddings Magazine retains editorial discretion regarding:

• Acceptance or rejection
• Editing
• Formatting
• Placement
• Publication timing
• Promotion
• Removal
• Technical modifications
• Headlines and captions
• Layout

Submitters are responsible for ensuring they have the rights and permissions necessary for all submitted materials.

Separate submission forms or agreements may contain additional terms.

13. Events, Bridal Shows, and Ticket Purchases

NOW Weddings Magazine may produce bridal shows, networking events, workshops, educational events, editorial events, vendor experiences, and other in-person or virtual programs.

Unless otherwise stated in writing, event registrations, tickets, sponsorships, exhibitor fees, and related event purchases are non-refundable except where required by law.

NOW Weddings Magazine reserves the right to postpone, reschedule, relocate, modify, substitute, or cancel an event when reasonably necessary.

Event dates, locations, schedules, speakers, exhibitors, programming, prizes, sponsors, or other elements may change due to circumstances including:

• Hurricanes
• Tropical storms
• Flooding
• Severe weather
• Venue issues
• Public safety concerns
• Government restrictions
• Transportation disruptions
• Power or utility failures
• Acts of God
• Other circumstances beyond our reasonable control

Where appropriate, NOW Weddings Magazine may provide information concerning rescheduling, credits, or other available options.

Attendance at events is voluntary, and attendees are responsible for complying with applicable event, venue, and safety requirements.

14. Photography, Video, and Media at Events

NOW Weddings Magazine events may be photographed, filmed, recorded, or otherwise documented.

By attending an event, you acknowledge that photography or recording may occur and that your likeness, image, voice, or appearance may incidentally appear in event coverage.

To the extent permitted by applicable law, you grant NOW Weddings Magazine and its authorized photographers, videographers, contractors, and media partners permission to use event photographs and recordings containing your likeness for lawful editorial, promotional, archival, social media, publication, public relations, and event-marketing purposes without additional compensation.

If a particular event requires a separate media release or contains additional photography terms, those terms will also apply.

15. Contests, Giveaways, and Promotions

Contests, giveaways, sweepstakes, door prizes, and promotional programs may be subject to additional eligibility requirements, official rules, or disclosures.

If separate official rules are provided, those rules apply in addition to these Terms.

If specific promotion rules conflict with these Terms, the specific rules will control for that promotion.

16. Vendor, Sponsor, and Advertiser Disclaimer

NOW Weddings Magazine provides opportunities for consumers and wedding professionals, venues, advertisers, sponsors, exhibitors, and other businesses to connect.

Inclusion in a NOW Weddings Magazine publication, vendor directory, website listing, advertisement, event, social media feature, sponsorship, or promotional campaign does not constitute a certification, warranty, or guarantee of the vendor, advertiser, sponsor, product, or service.

Consumers are responsible for researching and selecting vendors and service providers.

Except where expressly stated in writing, NOW Weddings Magazine is not a party to contracts between consumers and independent vendors.

17. No Guarantee of Results

NOW Weddings Magazine does not guarantee any particular result from a membership, advertisement, vendor listing, sponsorship, event, editorial feature, or promotional opportunity.

We do not guarantee:

• Event attendance
• Lead quantity
• Lead quality
• Bookings
• Sales
• Advertising performance
• Website traffic
• Search-engine rankings
• Social media reach
• Audience engagement
• Business growth
• Revenue
• Return on investment

Examples of past performance or results are illustrative only and do not guarantee future results.

Purchase of advertising or membership does not guarantee editorial coverage or endorsement unless expressly provided in a separate written agreement.

18. Advertising and Sponsored Content

NOW Weddings Magazine websites, publications, social media channels, emails, and events may include paid advertising, sponsorships, sponsored content, or promotional placements.

Paid placement does not itself constitute a guarantee or endorsement of an advertiser’s products or services.

Sponsored or paid content may be identified where required by applicable law.

19. Intellectual Property

Unless otherwise indicated, content owned by NOW Weddings Magazine, including articles, graphics, logos, branding, designs, publications, digital products, downloads, videos, guides, educational materials, page layouts, and website content, is protected by copyright, trademark, and other intellectual property laws.

No NOW Weddings Magazine-owned content may be reproduced, republished, distributed, sold, modified, transmitted, or commercially exploited without prior authorization except where permitted by law.

Digital downloads, guides, templates, educational resources, or premium content may be licensed for personal use only unless otherwise stated.

Such materials may not be redistributed, resold, shared, reproduced, or commercially exploited without permission.

20. Third-Party Links and Services

To the fullest extent permitted by applicable law, New Orleans Weddings Magazine, Inc., and its officers, directors, employees, contractors, agents, affiliates, licensors, sponsors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of our website, publications, events, memberships, products, or services.

To the extent permitted by applicable law, NOW Weddings Magazine’s aggregate liability for a claim arising from a paid service will not exceed the amount paid by the claimant to NOW Weddings Magazine for the applicable service during the twelve months preceding the event giving rise to the claim.

Nothing in this section limits liability that cannot legally be limited.

24. Responsibility for Submitted Content

Users are responsible for claims arising from content or materials they submit if the submission violates these Terms, applicable law, or another person’s rights.

This may include claims involving:

• Copyright infringement
• Trademark infringement
• Unauthorized use of photographs
• Privacy or publicity rights

Any indemnification obligations contained in a separate advertising agreement, membership agreement, submission release, or other written agreement also apply.

• Attempt unauthorized access to accounts or systems
• Upload malware or harmful code

Mandatory rights or venue requirements that cannot legally be waived are not affected by this section.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

31. Entire Agreement

These Terms, together with our Privacy Policy and any applicable membership terms, advertising agreements, releases, event rules, submission agreements, order forms, or other written terms, constitute the applicable agreement between you and NOW Weddings Magazine regarding the relevant service.
